All peptide, longevity, and wellness products (“Products”) sold by Peptagen Biosciences, LLC (“Peptagen”, “we”, “us”, or “our”) are sold “AS IS” and “AS AVAILABLE,” with all faults and without any warranty, guarantee, or representation of any kind, whether express, implied, statutory, or otherwise, to the fullest extent permitted by applicable law.
A. No Warranties or Guarantees
Peptagen makes no warranty or guarantee — express or implied — regarding the Products’ merchantability, fitness for a particular purpose, safety, efficacy, potency, purity, quality, non-infringement, or that use of the Products will achieve any particular result. Any description, statement, testimonial, or claim regarding the Products, whether made on our website, packaging, labeling, marketing materials, or by any representative, is provided for general informational purposes only and does not constitute a warranty or guarantee of any kind.
B. All Sales Are Final
Once a Product has been sold, shipped, delivered, resold, gifted, transferred, or otherwise changes hands or is transacted in any manner (“Transacted”), Peptagen assumes no further responsibility for that Product. All sales are final. Peptagen does not accept returns, exchanges, or refunds for any reason, including but not limited to buyer’s remorse, change of mind, dissatisfaction with results, adverse reaction, misuse, mishandling, improper storage, improper reconstitution or administration, or any outcome — positive, negative, or absent — associated with use of the Product, except where a return or refund is expressly required by applicable law.
C. No Liability After Transfer of Possession
Once title and possession of a Product pass to the purchaser or any subsequent holder, Peptagen bears no responsibility for that Product’s handling, storage, transportation, reconstitution, administration, combination with other substances, resale, or use. The purchaser assumes all risk and sole responsibility for the Product from the moment of transfer onward.
D. No Medical Claims
The Products have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease. The Products are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a licensed physician before using any peptide, longevity, or wellness product.
E. Limitation of Liability
To the maximum extent permitted by law, Peptagen, its owners, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to personal injury, loss of health, loss of profits, or loss of data — arising out of or related to the purchase, possession, or use of any Product, even if Peptagen has been advised of the possibility of such damages. Peptagen’s total aggregate liability for any claim relating to a Product shall not exceed the amount actually paid by the purchaser for that Product.
F. Assumption of Risk & Indemnification
By purchasing, accepting, or using a Product, the purchaser acknowledges and agrees that they do so entirely at their own risk and voluntarily assumes all risks associated with the Product. The purchaser agrees to indemnify, defend, and hold harmless Peptagen from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from their purchase, handling, storage, transfer, or use of any Product, or its use by any third party to whom they provide, sell, or transfer the Product.
G. Severability
If any provision of this statement is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
